People often get confused about certain fundamental aspects of what takes place in regards to bail after an arrest. And for most people, this is understandable. Most of us go through life without being arrested, but if that time comes, there are certain things you will need to know.

The words bail and bond are not synonymous

Bail is the amount of money that is required for the person charged with a crime to be released. A bond represents the money that is deposited with the court. The word bond is used because the money is paid back when the court proceedings are over. Sometimes you can post your own bond, but depending upon the jurisdiction, a friend or relative may have to do it. The entire amount of bail will need to be posted.

The function of a bail bond company

often, the bail asked for by the court, will be too high for a person. In this situation, a bail bondsman can be used. They will post the bond, and you will pay them a fee for doing it. This fee can vary, but most of the time it will be 10 percent of the total bail. After your trial or hearing is over, the court will refund the bond money to the bondsman. The fee you paid is non-refundable. This is how they make their money. Of course, you don't have to use a bondsman. If you can afford it, posting your own bond will save the fee of a bondsman, but many people don't want to tie up a lot of money with a bond while they wait for a trial.

You will need collateral if you decide to use a bondsman

A bonding company will post the full amount of bail on your behalf, keeping the approximately 10 percent as a fee. But if you don't show up for court, they will forfeit the entire bond. They are, in essence, loaning you money. For this reason, the bond will need to be secured with something of value that is at least the value of the bail amount. For large bail figures, you may need your spouse or relative to secure the bond with the equity in a house. Smaller amounts may only require the title to a car. Other assets are acceptable as well, but it depends upon the particular company that you are dealing with.
